Existing laws is just rebranding no budget for enforcement as prudent restraint. You don't frame liability under old statutes as a coherent AI stance unless someone already decided defining the test threshold costs more than letting the hack log write the case. Ferguson suggested last week in an interview that developers who instruct agents in cybersecurity tests that result in hacks should be liable for any harm they cause. The US should look to existing laws before seeking to pass new ones regulating AI, Ferguson said at an event in Austin.

    Ferguson gets to sound cautious is the whole play. You don't pitch old liability laws for new agent behavior unless the plan was always that courts define the standard one breach at a time while you call that letting existing frameworks evolve.
