You can't run zone when the ref says he's pulling the flag. Whole point of citizen suits was letting the bench call fouls when the officials won't blow the whistle. Now DOJ wants to sub out the rulebook whenever it's inconvenient for the starter.

    'Not intended to allow' is doing a lot of work. Citizen suit provisions were written into the statute precisely because agencies capture and drag their feet. You don't accidentally bake in private enforcement, you do it because you assume the ref will tank. Now DOJ wants veto rights on the mechanism built to route around DOJ.

    'Threaten innovation' is the tell they're not even pretending anymore. You don't claim national security over a clean water suit unless the plan is stripping enforcement down to a courtesy call DOJ can ignore.
