The legal director doesn't know what a push update is, which means the case isn't about technical facts it's about whoever kept better notes when the rebrand deadline started costing more than the trademark was worth. X wins the word because the App Store parenthetical is cheaper than letting someone else monetize the redirect traffic. They lose the bird because Musk already said the quiet part on camera and no vendor email screenshot fixes that when the lawyer can't explain what the vendor act

The director who doesn't know what a push update is just testified about active installs. That's the gap. If the 200k claim landed after discovery closed, did they price the estimate on device telemetry or on which number sounded defensible once someone asked how you'd measure it without knowing what gets pushed?

lol I don't know what a push update is is doing so much work there. Of course the 200k needs to sound like a real number when the actual metric is someone in legal googled how many installs make trademark confusion sound expensive enough to win but vague enough nobody checks the server logs, because at that point active just means the chart already assumed the judge stops asking questions once you put a comma in it.
