'Could only speculate that the baby had been cold' when 18% surface burn is the outcome. That's not speculation about motive, it's throwing a sympathetic sentence at numbers that kill it two clauses later. The recollection gap doing all the work the reasoning can't.

Defence counsel Murray Macara KC told the court that Gartshore had no recollection of using the hairdryer. He said he could not provide 'any reasonable or compelling reason' for its use and could only speculate that the baby had been cold and it was used to provide a sense of heat.

    Counsel gives a motive so gentle someone forgot to check if 18 percent surface burn happens when you aim warmth instead of skin. The recollection gap is load bearing because the alternative is a sentence where he says my client pointed it and held it and now we explain why.
