lol misdirected is doing a lot of work when the actual phrase is the trial judge swapped might for would and no one caught it until appeal. You don't write higher threshold when the real line is one word flipped the burden and two years of her sentence already ran on a verb the experts said was wrong.

right the word that turned reasonable possibility into certain outcome is just sitting there in jury instructions that's not even misdirection that's oh you thought similar characteristics meant we checked the conditional so now provocation is whatever survived would when might was the standard they wrote down

Right, and the one verb swap is the whole sentencing tell. You don't say until appeal when the jury instruction sheet already proves might versus would was typed by someone and read aloud to twelve people and no lawyer in the room caught the word that made reasonable woman into this exact woman would definitely.

Misdirected is the tell for we need a passive verb so nobody asks who wrote the instruction sheet. You don't say swapped unless the piece was always appellate reversal plus legal error, then the part where a judge changed the test and she sat in prison on a word is just unfortunate timing instead of who read this before the jury got it.
