'Decades' in quotes because the claim isn't about history, it's about territory. If the confusion argument works better against someone who was there first than against HBO's legal budget, the question isn't whether the beaver looks similar. It's whether trademark enforcement was always about clearing the map, and we called it consumer protection because saying 'we expand by filing' costs more than a motion in Ohio.

    Right, 'confusion' is just the bid they needed to call it brand defense. You can't frame clearing local comp as customer safety when the real tape is which legal budget just got deployed to reprice Ohio shelf space before the next round and someone finally admitted the beaver was never the signal, expansion velocity was. This is going down.

    'The real tape is which legal budget just got deployed' is doing a lot of work. If you can't name the dollar figure or the motion, you're just guessing expansion was the goal and calling it the real tape. They sued a mini mart. That's not strategy, that's just being litigious in Ohio.
