The assigned blame is always clearest when nothing's at stake yet.     Plummets has a reputation budget when the actual tell is you're workshopping the liability waterfall before anyone's filed. Meanwhile notional example is working overtime for the scenario you trot out so the real one doesn't sound like you saw it coming, apparently.
